These Terms of Use and Sale (the “Terms”) govern your access to and use of ongoenergy.com and any related pages, features, accounts, content, and online services operated by Smartkid Nutraceuticals, LLC d/b/a OnGo Energy (“OnGo,” “we,” “us,” or “our”) (collectively, the “Site”). These Terms also govern purchases made directly from us through the Site.
Please read these Terms before using the Site or placing an order. By using the Site, creating an account, submitting an order, or affirmatively accepting these Terms at checkout, you agree to these Terms and the policies incorporated into them. If you do not agree, do not use the Site or submit an order.

1. Company Information and Scope
The Site is operated by Smartkid Nutraceuticals, LLC, a New Jersey limited liability company doing business as OnGo Energy. Our business address is 125 Half Mile Road, Suite 200, Red Bank, New Jersey 07701.
These Terms apply to consumer purchases made directly through the Site. Purchases from Amazon, a retail store, a distributor, or another third-party seller are also subject to that seller’s terms, policies, and remedies. Separate written terms may govern wholesale, distributor, affiliate, promotional, or other business-to-business relationships.
The following policies are incorporated into these Terms and form part of your agreement with us:
- Subscription and Automatic Renewal Terms;

If a specific policy conflicts with these Terms on the subject it addresses, the specific policy controls for that subject.
2. Eligibility and Adult Use
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, place an order, enroll in a subscription, or use an OnGo product. OnGo products are intended for adults and are not intended for children.
By using the Site or placing an order, you represent that the information you provide is accurate, that you are authorized to use the payment method submitted, and that your use and purchase are lawful where you live.
3. Product Information and Responsible Use
OnGo is sold as a dietary supplement. Product formulations, packaging, flavors, serving instructions, warnings, and availability may change. Always read and follow the label on the product you receive. If Site content differs from the current product label, the current product label controls.
Information on the Site is provided for general product and educational purposes. It is not medical advice and is not a substitute for advice from a physician, pharmacist, dietitian, or other qualified healthcare professional. Review the Product Use, Safety, and Medical Disclaimer before using the product.
You are responsible for considering caffeine from all sources and for using the product only as directed. Do not use OnGo as a substitute for adequate sleep, medical care, or safe driving practices. Do not drive or operate equipment when fatigued or impaired merely because you have used a caffeine product.
4. Accounts
You may be able to create an account to view orders, manage a subscription, save information, or use other Site features. You must provide accurate and current information and keep it updated.
You are responsible for safeguarding your password and account credentials and for activity conducted through your account. Notify us promptly at support@ongospray.com if you believe your account or payment information has been used without authorization. We may require reasonable verification before changing account information or disclosing order details.
We may suspend or close an account for suspected fraud, unlawful activity, security concerns, abusive conduct, violation of these Terms, or another lawful reason. Closing an account does not automatically cancel a subscription; use the cancellation methods stated in the Subscription and Automatic Renewal Terms.
5. Orders and Acceptance
When you submit an order, you are offering to purchase the products shown in your cart at the price and on the terms presented at checkout. An automated order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it. We ordinarily accept an order when it is released for fulfillment or shipped.
We may reject, limit, or cancel an order before shipment for a lawful reason, including:
- product unavailability;
- an obvious pricing, description, or technical error;
- suspected fraud, payment abuse, or unauthorized use;
- quantities that appear intended for unauthorized resale or diversion;
- geographic or legal restrictions;
- an inability to verify information; or
- violation of these Terms.
If we cancel an order after collecting payment, we will issue a prompt refund to the original payment method. We may limit quantities by person, household, payment method, account, address, or order. Products purchased through the consumer Site are for personal use unless we agree otherwise in writing.
6. Prices, Taxes, Promotions, and Availability
Prices are displayed in U.S. dollars unless stated otherwise. The price, discount, shipping charge, tax, subscription frequency, and other material terms shown in the final checkout summary control the transaction.
Applicable taxes and shipping charges are calculated and disclosed at or before checkout. Prices and availability may change prospectively without notice, but a price change will not alter an order that we have already accepted unless you agree or the displayed price was an obvious error.
Promotions, coupons, referral credits, giveaways, free gifts, and limited-time offers may have additional terms. Unless the offer states otherwise, promotions cannot be combined, have no cash value, are not retroactive, and may be modified or ended prospectively. We will not change the material terms of an offer after you have completed a qualifying purchase.
Product images are illustrative. Packaging and visual details may vary, but we will not knowingly substitute a materially different product without notice and, where required, your consent.
7. Payment
We accept the payment methods shown at checkout. By submitting payment information, you represent that you are authorized to use the payment method and authorize us and our payment providers to charge the total shown at checkout.
Payment processing is performed by third-party payment providers. We generally receive transaction information such as payment status, card brand, a token, and limited card details rather than the full payment-card number. Your use of a payment option may also be subject to the provider’s terms and privacy notice.
If a payment is declined, reversed, disputed, or otherwise not completed, we may withhold shipment, cancel the order, suspend a subscription, or seek amounts lawfully due. Nothing in these Terms limits your right to challenge an unauthorized or incorrect charge with us, your bank, or a payment provider.
8. Shipping and Delivery
Our Shipping Policy describes where we ship, estimated processing and transit times, rates, tracking, delays, address errors, lost packages, and other delivery terms. Delivery dates are estimates unless we expressly state that a date is guaranteed.
Responsibility for loss or damage is determined under applicable law and our Shipping Policy. Contact us promptly if an order is missing, damaged, or delivered incorrectly so we can investigate and provide any remedy required by law or our policies.
9. Returns and Refunds
Our Refund and 30-Day Money-Back Guarantee Policy controls returns, opened-product eligibility, return shipping, refunds, damaged or incorrect orders, and purchases from third-party sellers.
Cancellation of a subscription stops future recurring orders as described in the Subscription and Automatic Renewal Terms. It does not automatically cancel or refund an order that has already been processed or shipped. A processed subscription shipment may still qualify for return under the Refund and 30-Day Money-Back Guarantee Policy.
10. Subscriptions
A subscription automatically renews and creates recurring charges until canceled. Before you enroll, the Site will disclose the product, quantity, recurring price, billing frequency, shipping terms, cancellation method, and any promotional period. You must affirmatively consent to the recurring terms.
Subscriptions are governed by the Subscription and Automatic Renewal Terms. You may cancel future renewals online through the available account or cancellation link, by emailing support@ongospray.com, or by another method stated in the subscription acknowledgment. “Cancel anytime” means there is no minimum commitment and you may stop future unprocessed renewals; it does not promise a refund for an order already processed.
11. Intellectual Property
The Site and its content—including text, graphics, photographs, videos, product designs, software, logos, trade dress, and compilations—are owned by or licensed to OnGo and are protected by intellectual-property laws.
“OnGo,” “OnGo Energy,” “OnGo Energy Spray,” related logos and slogans, and other OnGo identifiers are trademarks or trade dress of OnGo or its licensors. Third-party names and marks belong to their respective owners. Use of a third-party mark for identification or comparison does not imply sponsorship, affiliation, or endorsement.
We grant you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the Site for lawful, noncommercial purposes. You may not copy, reproduce, modify, distribute, sell, exploit, frame, scrape, reverse engineer, or create derivative works from the Site except with our prior written permission or as allowed by law.
If you believe content on the Site infringes your copyright or other rights, send a detailed notice to support@ongospray.com identifying the work, the allegedly infringing material, its location, your contact information, and the basis for your claim.
12. Reviews and Other Public Content
If you submit a review, image, video, social-media tag, contest entry, or other material intended for public display (“Public Content”), you retain ownership of it. You grant OnGo a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, display, adapt for formatting, distribute, and use that Public Content in connection with our products, Site, advertising, and business, subject to applicable law and any privacy choices you communicated when submitting it.
This license does not apply to private customer-service messages, payment information, medical details, or adverse-event reports merely because you sent them to us. We handle those communications under the Privacy Policy and applicable law.
You represent that your Public Content is based on a genuine experience, is accurate to the best of your knowledge, does not violate another person’s rights, and is not unlawful, threatening, defamatory, obscene, deceptive, or infected with malicious code. You must clearly disclose any material connection to OnGo, including free products, discounts, compensation, employment, ownership, or a family relationship.
We may moderate or remove Public Content for legitimate reasons such as fraud, irrelevance, spam, threats, unlawful content, privacy violations, conflicts of interest, profanity, or failure to disclose a material connection. We do not promise to publish every submission, but we will not suppress a genuine review merely because it is negative. The Reviews and Testimonials Policy contains additional details.
13. Feedback and Unsolicited Ideas
You may send comments or suggestions about the Site or products. Unless we separately agree in writing, feedback is not confidential and may be used by us without compensation or attribution. This provision does not transfer ownership of your preexisting intellectual property and does not apply to private health, payment, or customer-service information.
Do not send confidential product formulas, inventions, or business proposals unless we have signed a separate confidentiality agreement.
14. Prohibited Conduct
You may not use the Site to:
- violate any law or another person’s rights;
- submit false, misleading, fraudulent, or impersonated information;
- obtain products for unauthorized resale, diversion, or unlawful use;
- interfere with the Site, servers, networks, checkout, security, or access controls;
- transmit malware, harmful code, or automated traffic that burdens the Site;
- scrape, crawl, harvest, or collect data except as permitted by law or our written authorization;
- access another person’s account or payment information;
- send spam, phishing, or deceptive communications;
- harass, threaten, defame, or discriminate unlawfully; or
- use Site content to train or operate a commercial artificial-intelligence system without written permission, except to the extent a restriction is prohibited by law.
We may investigate suspected violations and cooperate with payment providers, service providers, regulators, or law enforcement when permitted or required by law.
15. Third-Party Services and Links
The Site may use or link to services provided by ecommerce platforms, payment processors, subscription managers, carriers, analytics providers, advertising platforms, social networks, marketplaces, or other third parties. A link or integration does not mean that we endorse all content or practices of that third party.
Third-party services may be governed by their own terms and privacy notices. We are responsible for our own conduct and legal obligations, but we do not control an independent third party’s website, service availability, security, or content.
16. Site Availability; Errors and Corrections
We work to keep the Site available and accurate, but we do not guarantee uninterrupted or error-free operation. Maintenance, outages, security events, carrier failures, platform issues, or events beyond our reasonable control may affect the Site or fulfillment.
We may correct typographical, technical, pricing, availability, or description errors. If a correction materially changes an order before shipment, we will notify you and, where appropriate, allow you to cancel for a full refund. We will not use this section to avoid responsibility for accurate ingredient information, legally required warnings, or other non-waivable obligations.
Historical articles or archived content may not describe the current product. The current product label and current checkout disclosures control.
17. Disclaimers
To the fullest extent permitted by law, the Site is provided on an “as available” basis. We do not promise that the Site will always be uninterrupted, secure, free from harmful components, or compatible with every device. We do not endorse or guarantee user-generated content.
Except for warranties expressly stated by us and warranties that cannot lawfully be excluded, we disclaim implied warranties relating to the Site. Nothing in these Terms excludes any warranty, remedy, or consumer right that applicable law does not permit us to exclude.
OnGo products are subject to the representations, directions, warnings, and warranties on the current label and to applicable law. We do not disclaim liability for a defective, adulterated, contaminated, or materially mislabeled product where liability cannot lawfully be disclaimed.
18. Limitation of Liability
To the fullest extent permitted by law, neither OnGo nor its officers, employees, affiliates, or agents will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the Site or these Terms, including lost profits or lost data, when those damages were not the direct and foreseeable result of our conduct.
For claims that may lawfully be limited, our aggregate liability will not exceed the greater of (a) $100 or (b) the amount you paid directly to OnGo through the Site during the 12 months before the event giving rise to the claim.
The exclusions and cap above do not apply to the extent prohibited by law and do not limit liability for:
- death or personal injury caused by legally actionable conduct;
- a defective, adulterated, contaminated, or materially mislabeled product;
- fraud or intentional misrepresentation;
- gross negligence or willful misconduct;
- violation of confidentiality, privacy, or data-security duties that cannot lawfully be limited; or
- any other right or remedy that cannot lawfully be waived or limited.
Notice for New Jersey Consumers: Nothing in these Terms waives or limits any right or remedy that cannot lawfully be waived or limited under the New Jersey Consumer Fraud Act, the New Jersey Truth-in-Consumer Contract, Warranty and Notice Act, the New Jersey Products Liability Act, or any other applicable New Jersey law.
19. Your Responsibility for Certain Claims
You agree to reimburse OnGo for losses, liabilities, and reasonable costs arising from a third-party claim caused by your unlawful use of the Site, your material breach of these Terms, Public Content that you submitted in violation of another person’s rights, or your unauthorized resale or intentional misuse of an OnGo product.
You are not responsible under this section for a claim caused by OnGo’s own negligence, willful misconduct, legal violation, or product defect. We will provide reasonable notice of a covered claim and allow you to participate in the defense, but we may control the defense and settlement if the settlement does not impose an admission or nonmonetary obligation on you without your consent.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, except that federal law governs issues within its scope.
Before filing a lawsuit, the parties should make a good-faith effort to resolve the dispute. You may send a written description of the issue and requested resolution to support@ongospray.com or to our mailing address. This informal process does not prevent either party from seeking urgent relief and does not shorten or waive any legal deadline.
Unless applicable law gives you the right to bring a claim elsewhere, a legal action arising from these Terms or a direct purchase from us must be brought in the state courts located in Monmouth County, New Jersey, or the federal court serving that county. Small-claims actions may be brought in any court that has lawful jurisdiction.
21. Changes to These Terms
We may revise these Terms prospectively. We will post the revised version with a new “Last Updated” date. If a change is material, we will provide reasonable notice by email, account message, checkout notice, or a prominent Site notice as appropriate.
Material changes will not retroactively alter a completed purchase. Changes to subscription prices or renewal terms are handled under the Subscription and Automatic Renewal Terms and applicable law.
22. Suspension and Termination
You may stop using the Site at any time. We may suspend or terminate access for a material violation of these Terms, suspected fraud, security risk, unlawful activity, abusive conduct, or another lawful reason.
Provisions that by their nature should survive termination—including payment obligations, intellectual-property provisions, limitations of liability, dispute terms, and rights relating to previously submitted content—will survive.
23. Miscellaneous
These Terms and the incorporated policies are the complete agreement concerning consumer use of the Site and direct purchases from us, except for any separate written agreement that expressly applies.
If we do not enforce a provision immediately, we do not waive it. If a provision is held unenforceable, it will be narrowed or severed only to the extent necessary, and the remaining provisions will continue.
You may not transfer your account or rights under these Terms without our consent. We may transfer these Terms as part of a merger, financing, reorganization, sale of assets, or similar transaction, subject to applicable privacy law.
Electronic notices and records satisfy written-notice requirements to the extent permitted by law. We are not liable for delay caused by events beyond our reasonable control, but this does not excuse duties to provide legally required notices, refunds, or remedies.

Subscription and Automatic Renewal Terms

These Subscription and Automatic Renewal Terms apply when you enroll in a recurring delivery plan offered by Smartkid Nutraceuticals, LLC d/b/a OnGo Energy (“OnGo,” “we,” “us,” or “our”) through ongoenergy.com. They supplement the Terms of Use and Sale.
Recurring Charge Notice: A subscription automatically renews at the frequency shown at checkout, and we will charge the payment method you provide for each renewal until you cancel. The checkout will show the product, quantity, recurring price, billing frequency, shipping terms, taxes, and how to cancel before you enroll. You may cancel future renewals at any time. Cancellation does not automatically cancel or refund an order that has already been processed.
1. Plan Terms Shown at Checkout
Before you enroll, we will clearly display the material terms of the plan, including:
- the product and quantity included in each shipment;
- the recurring price or a clear method for determining it;
- the billing and delivery frequency;
- applicable shipping charges or free-shipping terms;
- applicable taxes;
- the duration of any introductory, promotional, or trial price;
- when regular pricing begins;
- the cancellation method; and
- any minimum purchase requirement, if one applies.
OnGo currently offers monthly product-delivery plans. If a checkout offers a different frequency, the frequency shown and affirmatively accepted at checkout controls.
2. Automatic Renewal and Billing Authorization
By affirmatively selecting a subscription and completing checkout, you authorize OnGo and its payment providers to charge the payment method you submit for the initial order and each recurring renewal until you cancel.
Your subscription continues automatically from one billing period to the next. There is no minimum commitment unless a specific offer clearly states one before enrollment. If an offer says “cancel anytime,” you may cancel future, unprocessed renewals without an early-cancellation fee.
You must separately consent to the recurring terms. A purchase of a one-time product does not enroll you in a subscription.
3. Confirmation and Records
After enrollment, we will provide an electronic acknowledgment that you can retain. It will identify the subscription, recurring price and frequency, cancellation policy, and at least one cancellation method. Keep the acknowledgment for your records.
We may retain records of the disclosure presented, your affirmative consent, the transaction, and later changes or cancellation for the period required by applicable law and reasonably necessary to resolve billing disputes.
4. Billing Date and Processing Cutoff
The first charge occurs when stated at checkout. Later charges ordinarily occur on or around the corresponding date in each billing cycle. Weekends, holidays, inventory, payment processing, or carrier schedules may cause a billing or shipment date to move slightly.
A renewal order may enter processing shortly before or at the time of the recurring charge. To avoid the next charge or shipment, cancel before that order is processed. The account page or subscription notice may show the next processing date.
If you cancel after a renewal order has already been processed, cancellation will apply to later renewals. The processed order may still qualify for return under the Refund and 30-Day Money-Back Guarantee Policy.
5. Managing a Subscription
Where the subscription system permits, you may be able to skip a shipment, pause the plan, change quantity, change an address, change a payment method, or move the next order date. A requested change is effective only when confirmed and may not apply to an order already processing.
Plan changes are subject to product availability, current prices, and the options displayed in your account. Changing a plan may end an earlier promotional price; we will disclose the effect before you confirm the change.
6. How to Cancel
You may cancel future renewals using any cancellation method made available in your subscription acknowledgment, including:
- the direct Manage Subscription or Cancel Subscription link or button in your online account;
- the cancellation link included in a subscription email;
- an immediately accessible electronic cancellation method supplied by us;
- email to support@ongospray.com; or
- phone at 888-489-6646.
If you enrolled online, we will make an online cancellation method available. We may reasonably authenticate your account before cancellation, but we will not require unnecessary steps or obstruct the cancellation.
A valid cancellation received through an offered method stops future renewals. An online cancellation takes effect immediately when the Site displays confirmation. For an email or telephone request, we use the time the valid request was received to determine whether the next order had already entered processing. We will send confirmation. If you leave a voicemail, include your name, order email, and phone number so we can identify the account; we will process the request or return the call within one business day.
7. Promotional Prices, Gifts, and Trials
Any free gift, trial, introductory price, or limited promotional rate will be described before enrollment. The checkout will disclose the price that applies after the promotional period and when that price begins.
Where required by law, we will send an advance reminder before a trial or promotional price lasting more than 31 days ends and before an annual or longer plan renews. The reminder will state the upcoming price or range of charges and provide a direct cancellation method.
A separate promotional item that is different from the subscribed product does not change the recurring terms unless the offer expressly states otherwise.
8. Price and Material-Term Changes
We may change a subscription price, shipping charge, product quantity, frequency, or another material term prospectively. We will provide clear advance notice and cancellation instructions before the change takes effect.
For a fee increase, we will provide the advance notice required by applicable law. As a nationwide operating standard, we will send a notice 7 to 30 days before the increase takes effect, with any additional or earlier notice required by law.
A material substitution will not be made without notice. If the subscribed product is unavailable, we may delay or skip the shipment, offer an alternative for your approval, or cancel and refund the affected order.
9. Payment Failures
You must keep a valid payment method on file. If a charge fails, we or our provider may retry it and notify you. We may pause or cancel the subscription after unsuccessful attempts. We will not knowingly continue shipping recurring orders for which payment has not been authorized.
Updating a payment method does not revive a canceled subscription unless you affirmatively reactivate it.
10. Shipping, Returns, and Refunds
Each subscription shipment is subject to the Shipping Policy and the Refund and 30-Day Money-Back Guarantee Policy. Shipping charges and free-shipping eligibility are shown before enrollment and may change prospectively with notice.
Canceling the subscription is different from returning a product. Canceling stops future unprocessed renewals. Returning an already delivered shipment requires compliance with the return policy.
11. Termination by OnGo
We may terminate or suspend a subscription for suspected fraud, payment abuse, unlawful resale, repeated delivery failure, product unavailability, violation of the Terms of Use and Sale, or another lawful reason. If we terminate after charging for an order that we do not ship, we will refund that order.
12. Applicable Law
These Subscription Terms are governed by the governing-law and dispute provisions in the Terms of Use and Sale. Nothing in these Subscription Terms limits any non-waivable right under federal or state automatic-renewal, negative-option, payment, or consumer-protection law.

Product Use, Safety, and Medical Disclaimer

Read the product label before use. This page provides general information and does not replace the directions, warnings, ingredients, Supplement Facts, or other information on the product you receive.
1. Dietary Supplement; No Medical Advice
OnGo is a dietary supplement, not a drug. Information on the Site, in advertisements, in reviews, or from customer service is not medical advice and is not intended to diagnose, treat, cure, or prevent a disease. Ask a qualified healthcare professional about your individual health, symptoms, medications, or treatment.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
This disclaimer must be read together with any structure/function or general-wellness claim to which it relates.
2. Adult Use and Caffeine
OnGo products are intended for adults age 18 and older. Keep the product out of reach of children.
For the current OnGo Energy Spray MAX product as of the date above, the label states that four full sprays provide 100 mg of caffeine and that the bottle contains 15 servings. Formulations and directions may change; always follow the current label.
Caffeine is also found in coffee, tea, soda, energy drinks, pre-workout products, medicines, foods, and other supplements. Consider your total intake from all sources. Do not exceed the product directions.
3. Ask a Healthcare Professional Before Use
Consult a qualified healthcare professional before use if you:
- are pregnant, trying to become pregnant, or nursing;
- are sensitive to caffeine or other stimulants;
- have a heart, blood-pressure, anxiety, sleep, neurological, liver, kidney, or other medical condition;
- take prescription medication, nonprescription medication, or another supplement;
- have been advised to restrict caffeine; or
- have concerns about an ingredient or interaction.
Do not use the product if you are allergic or sensitive to an ingredient. Review the full ingredient list on the label.
4. Use as Directed
Shake, spray, swallow, store, and use the product only as directed on the label. A complete actuation may be necessary to deliver the labeled amount. Do not estimate a serving from an incomplete spray.
Do not intentionally combine OnGo with excessive amounts of caffeine or stimulants. Stop use and seek medical advice if you experience a concerning reaction such as severe dizziness, chest pain, fainting, difficulty breathing, a rapid or irregular heartbeat, severe anxiety, confusion, persistent vomiting, seizure, or another significant symptom.

5. Not a Substitute for Sleep or Safe Judgment
Caffeine may increase alertness but does not eliminate impairment from sleep deprivation. OnGo is not a substitute for adequate sleep and should not be used to justify driving, operating machinery, working in a dangerous setting, or performing another safety-sensitive task while fatigued or impaired.
6. Timing and Individual Results
Caffeine response varies based on body size, tolerance, food intake, sleep, medications, other caffeine use, and individual physiology. References to “instant” describe the ability to use the spray immediately and conveniently; they do not guarantee an instantaneous physiological effect.
Statements that users may feel an effect “within minutes,” duration estimates, and testimonials describe reported or expected experiences and are not guarantees. Individual results vary.
7. Product and Ingredient Claims
Objective claims about speed, absorption, endurance, focus, fatigue, productivity, “crash,” “jitters,” safety, or superiority require support appropriate to the exact claim and finished product. A general study about caffeine or an isolated ingredient may not establish the same result for the OnGo formula or delivery system.
The use of “natural caffeine” refers to the disclosed caffeine sources; it does not mean caffeine is risk-free or appropriate for every person.
